What does this mean to Solicitors?
For loans granted after 1st May 2000 HM Land Registry no longer issue a Charge Certificate. Details normally found within the Charge Certificate are held on their computer records.

Have all Lenders dematerialised deeds?
This is the general practice following the introduction of the HM Land Registration Act 2002
Are you retaining the original lease in respect of leasehold property?
No - you will be instructed to send this to the borrower. HM Land Registry will retain a copy in their files.
Why are you dematerialising?
This was an initiative promoted by HM Land Registry as they want to be the main record keeper of registered property. The main advantage to the Lender is that ever increasing space is required to store the documents and deeds administration is a labour intensive process. Our staff are not legally qualified to answer many of the queries raised by our customers and so it makes sense for HM Land Registry to be the focal point for reference.
Our tracker rate mortgages are linked to Bank of England base rate (also know as Bank of England repo rate). Details of this rate can be found on the Bank of England website or in the Financial Times or other leading newspapers.
